1. Acceptance of Terms
By accessing or using CalgaryArea.com ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all visitors, users, business owners, and anyone who accesses the Platform.
2. Description of Service
CalgaryArea.com is a local business directory for the Calgary metropolitan area. The Platform allows users to discover, compare, and evaluate local businesses. Business owners can register listings, claim ownership, manage their business information, and access engagement analytics.
3. User Accounts
3.1 Business Owner Accounts
When you claim a business listing, we create an account with login credentials sent to your verified email. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
3.2 Eligibility
You must be at least 18 years old and legally authorized to represent the business you are claiming or registering. By claiming a listing, you represent and warrant that you are an authorized representative of that business.
4. Business Listings
4.1 Listing Content
Business owners are responsible for the accuracy of the information they provide. You agree not to submit false, misleading, or deceptive information. We reserve the right to remove or modify listings that violate these terms or contain inaccurate information.
4.2 Third-Party Data
Some listing information (ratings, reviews, photos, addresses) may be imported from third-party sources including Google Places. This data is provided "as is" and we do not guarantee its accuracy. Business owners may update their information through their owner dashboard.
4.3 Free Listings
Basic business listings on CalgaryArea.com are currently provided free of charge. We reserve the right to introduce premium features or paid tiers in the future, but existing free listings will not be removed or degraded without notice.
5. Claim Process
To claim a business listing, you must provide verification information including your name, email, phone number, and business registration number. Claim requests are reviewed and may be approved or rejected at our discretion. We may request additional documentation to verify ownership. Providing false information in a claim request is a violation of these terms and may result in account termination.
6. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent business information.
- Claim a business you do not own or are not authorized to represent.
- Use automated tools to scrape, crawl, or extract data from the Platform without written permission.
- Attempt to interfere with the Platform's operation, security, or other users' experience.
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Submit content that is defamatory, obscene, harassing, or that infringes on any intellectual property rights.
- Manipulate reviews, ratings, or analytics data.
7. Intellectual Property
The Platform's design, code, branding, and original content are the property of CalgaryArea.com. Business owners retain ownership of the content they submit (descriptions, photos, logos) and grant us a non-exclusive, royalty-free license to display that content on the Platform. Google-sourced data (ratings, reviews, photos) is subject to Google's Terms of Service.
8. Consumer Choice Award (CCA) Data
CCA winner designations displayed on the Platform are based on publicly available award data. CalgaryArea.com is not affiliated with, endorsed by, or sponsored by the Consumer Choice Award organization. CCA status is displayed for informational purposes only.
9. Limitation of Liability
CalgaryArea.com is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all liability for any damages arising from your use of the Platform, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
We do not guarantee the accuracy, completeness, or reliability of any business information, ratings, reviews, or pricing displayed on the Platform. Users should independently verify business information before making purchasing decisions.
10. Indemnification
You agree to indemnify and hold harmless CalgaryArea.com, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your infringement of any third party's rights.
11. Termination
We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, with or without notice, for conduct that we determine violates these terms or is harmful to other users, the Platform, or third parties.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Alberta, sitting in Calgary.
13. Changes to These Terms
We may update these Terms of Service at any time. Material changes will be posted on this page with an updated date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
